“Earn the right to buy passes to the 2019 George Enescu International Festival”

  1. Campaign organiser „Câștigă dreptul de a cumpăra abonamente la Festivalul Internațional George Enescu 2019” (Earn the right to buy passes to the 2019 George Enescu International Festival)

The organisers of the Campaign, which will take place on the www.eventim.ro website, are:

1.1. ARTEXIM, with registered office in Bucharest, Victoria Business Center, 155 Calea Victoriei, Building D1, Entrance 8, ​​2nd floor, District 1, code 010073, having the account RO65TREZ7015001xxx000005 opened at Treasury District 1, represented by Mihai Constantinescu – General Manager, Gabriela Stoican – Chief Accountant and Mihaela Cunita – Legal Advisor, as organiser of the “George Enescu” International Festival 2019 edition and

1.2. The company EVENTIM.RO SRL, with registered office in Bucharest, 5 Popa Petre Street, 2nd floor, part 2, lot 5, District 2, registered with the Trade Registry under no. J40 / 7871/2007, Sole Registration Code 21597760, bank account RO19RZBR0000060014758795 opened at Raiffeisen Bank – Calea Dorobanti Agency, legally represented by administrator Ionuţ Buhă, as a ticketing company authorised by the organiser to sell the tickets to the Festival.

 

This Campaign is organised taking into account the fact that in the previous editions of the Festival there was a huge volume of requests for festival passes. In order to improve its services, Artexim together with Eventim.ro, the festival’s official ticketing partner, organises a campaign for the selection of participants who will be able to purchase festival passes. Thus, the chances of buying passes to the George Enescu Festival will be equal for all interested persons. Pertinent information on the way the Campaign will be conducted can be found on eventim.ro/loterie/ and www.festivalenescu.ro.

 

The campaign will be conducted under this Regulation, the provisions of which are binding on all participants. Participation in this Campaign implies acceptance by the Participants of the provisions of this Regulation. The regulation and campaign details are available free of charge to any applicant on www.eventim.ro for the entire duration of the campaign.

Considering that passes to the George Enescu International Festival 2019 will be sold by Eventim.RO S.R.L. in the name and on behalf of ARTEXIM, Eventim.RO (hereinafter referred to as the “Organiser”) will deal with all details of the Advertising Campaign, in accordance with the terms and conditions set forth below.

 

 

  1. Place of the campaign:

The campaign for sale of festival passes is organised and takes place exclusively on the territory of Romania, at the Romanian Athenaeum, at Eventim.RO work units, on the website eventim.ro/loterie/, and the drawing will be held by electronic means. In order to participate in this campaign, each participant is required to fill in the registration form available at the Romanian Athenaeum at Eventim work units and on the website eventim.ro/loterie/ with: last name, first name, phone, e- mail, postal address, all of these data being valid, identical to those in the ID card, and to go through the campaign registration procedure, expressing their express agreement as to the participation and content of this Regulation, as instructed on the website.

 

  1. Campaign period:

The campaign will begin on 22 October 2018 starting at 14:00:00 and will end on 1 February 2019 at 15:00:00. It is divided into the following periods:

Registration period: 22.10.2018 – 25.11.2018

Drawing: 26.11.2018

Payment period: 27.11.2018 – 12.12.2018

Shipping period: 12.12.2018 – 01.02.2019

 

The winning mechanism is drawing, and the drawing will be made automatically through the random.org application by Eventim.RO, among all eligible participants registered. The results of the drawings will always be published on the website www.eventim.ro.

  1. Right of participation:

Any person under the age of 18, irrespective of gender, nationality or religion, may participate in this campaign. By way of exception, employees of the Organiser or its partners, as well as their spouses and relatives up to and including 3rd degree, may not participate in the campaign.

All participants must be resident or domiciled in Romania.

  1. Signing up for the campaign:

To participate in the campaign, based on its specificity, participants must meet the following cumulative conditions at the time of signing up for the campaign:

  1. a) to fill in the registration form available at the Romanian Athenaeum, at the Eventim work unit and on the website eventim.ro/loterie/, with all the required data;
  2. b) to visit the campaign page and follow the instructions described in order to participate;
  3. c) by signing up for the campaign, the participant guarantees that he / she is at least 18 years old and that he / she can subsequently prove with civil status documents the fulfilment of this participation condition.

It is strictly forbidden to register an individual with multiple accounts and / or multiple email addresses to the campaign.

The organiser reserves the right to delete obscene comments or other types of texts that promote violence, inappropriate language or political affiliations, etc. The organiser reserves the right not to validate the registration of participants who do not meet the requirements of the campaign. The organiser reserves the right to remove from the page the interventions and participants who generate inappropriate conversations regarding the campaign, ignoring the provisions of this regulation or having repeated requests beyond the provisions of this regulation.

A participant may be disqualified (through the deletion of user-published information) at any time if the Organiser notices any behaviour deemed inappropriate to the campaign and this regulation.

The organiser considers the campaign’s registration to be an implicit acceptance of this regulation and considers any data regarding the participant as true and fair. In the event of any inconsistencies regarding the above, the Organiser will not consider such a participation as valid, the participant being disqualified.

  1. Prizes:

The prizes awarded within the Sales Campaign “Earn the right to buy passes to the 2019 George Enescu International Festival” assume the winners’ right to buy passes to the Festival.

The right to buy passes to the 2019 George Enescu International Festival does not in itself have commercial value, as each winner will pay the actual price of the passes as they are communicated.

In this campaign, it is not possible to replace the prize by cash equivalent in and / or other items, as it is not allowed in any case to transfer the prize won to one or more third parties.

The winner will receive information about the winning prize on the emails specified in the campaign registration procedure.

The prizes awarded within the Campaign will consist of the right to purchase the following types of passes to the George Enescu International Festival 2019 edition:

Great Orchestras of the World passes (Grand Palace Hall)

Category I – 3,080 RON (music stamp duty included)

Category II – 2,420 RON (music stamp duty included)

Category III – 1,870 RON (music stamp duty included)

Category IV – 1,320 RON (music stamp duty included)

Retirees, Pupils, Students – 990 RON (music stamp duty included)

 

Recitals and Chamber Music passes (Romanian Athenaeum)

Category I – 3,105 RON (music stamp duty included)

Category II – 2,415 RON (music stamp duty included)

 

By Midnight Concerts passes (Romanian Athenaeum)

Category I – 1,840 RON (music stamp duty included)

Category II – 1,380 RON (music stamp duty included)

 

Music of the 21st Century passes (Radio Hall)

 

Category I – 300 RON (music stamp duty included)

Category II – 200 RON (music stamp duty included)

 

  1. Campaign development – description

The calendar for the Campaign includes the following periods:

  1. a) Registration period: 10.2018 – 25.11.2018
  2. b) Winners’ drawing: 11.2018
  3. c) Payment period for the festival passes price: 11.2018 – 12.12.2018
  4. d) Ticket delivery period: 12.2018 – 01.02.2019

Starting 22 October 2018, the campaign registration will be made by a registration form at the Romanian Athenaeum, at Eventim work units and at www.eventim.ro, for each category of passes.

The participant will enter his / her name, telephone number, postal address and e-mail address. A person can only sign up once. The participant will also have the option of choosing whether tickets are to be sent by e-mail, mail, or picked up from one of Eventim’s premises.

The participant will choose the type of pass he/she wants. It can be individual (only one person) or family (2 people). If several people want to benefit from the festival pass, they must do a new registration with different details (for example: if a 4-member family wants two family passes, then two different people in that family will need to sign up to ensure chances of winning for 4 people).

Participants will be able to select the price category they want by viewing their distribution in the room plan. After drawing, festival pass orders will be created automatically, the system offering the best places available in the selected category.

On 25 November 2018, the registration period will end.

On 26 November 2018, drawing will take place for each type of pass, thus creating winning lists for each type of pass. A distinct waiting list for each type of pass will be created through a second drawing to ensure the distribution of the passes that the original winners will not pay within the specified timeframe.

 

After the drawing, the winners will receive a link on e-mail via which they can pay for the passes. Passes will have to be paid within 7 calendar days of receipt of the payment link email. This period will end on 12 December 2018, taking into account the fact that emails cannot be sent on the same day to all winners. The organiser disclaims any liability in the event that the winning participant cannot be contacted or does not respond to the email whereby he/she is informed that he/she is the winner of the campaign.

After the drawing, winners will receive a link on e-mail via which they can pay for the passes. Passes will be paid by 12 December 2018. The organiser disclaims any liability if the winning participant cannot be contacted or fails to respond to the email whereby he/she is informed that he/she is the winner of the lottery.

 

A participant can win a single prize throughout the campaign.

The Organiser reserves the right to use the data of the winners of the campaign to publicly announce their names, home city and winning prizes on the www.eventim.ro website, in accordance with the legislation in force.

 

The organiser reserves the right to decide at any time on the end of the campaign or prize award.

  1. Personal Data Protection:

Your personal data collected during campaign and ticket sales will be processed according to the information note available at www.eventim.ro/en/dpp/dpp.html or at Eventim work units.

  1. Responsibility

EVENTIM.RO does not assume responsibility for any situation created as a result of participating in the Campaign.

Also, the Organiser assumes no responsibility for anything that may cause the user of www.eventim.ro  to be unable to participate in the campaign or the proper conduct of the activities described in this regulation as a result of technical, financial or other Internet-specific limitations, such as the inoperability of the web site, the lack of functionality of Internet services.

  1. Drawing

The drawing for the awarding of prizes will be made on 26.11.2018, during which the winners will be selected.

A participant may be declared a winner only once (based on the Personal Identification Number), if it is discovered that he/she has participated in the campaign with multiple emails, forms, accounts, and he/she will be disqualified.

The drawing will take place at the Romanian Athenaeum and will be done by electronic means, based on the random.org website without the possibility of human intervention in the winner’s selection algorithm, in front of a committee of three persons designated by the Organiser, who will conclude a report for the designation of winners.

Participants will be declared winners only if they cumulatively fulfil the conditions for participation and the conditions for awarding the prizes referred to in this Regulation. If these conditions are not met, the conditions for the participation and award of the prizes to the reserve winners will be checked in order, until the winner has been designated.

The prizes will be given in the form of the right to buy the type of pass to the “George Enescu” International Festival, 2019 edition, for which the winning participant has joined the Campaign.

If the winning participant does not meet the conditions for participation or award of prizes, it is disqualified, he/she is unable to present himself / herself for verification of the identity and for signing the report of acceptance of the prize within the given terms, regardless of reason (fortuitous / force majeure event) or if they refuse to take possession of the prize, the Organiser will award the prize to the winning reserve participants in the order of the drawing.

  1. Prize award conditions:

Prizes will be awarded to the winner only if he/she meets the following cumulative conditions:

  1. a) Only participants with the minimum age of 18 years and full exercise capacity at the time of being declared winners can be declared winners.
  2. b) The winner should not be declared disqualified as a result of non-compliance with this regulation.
  3. c) Storing these data and processing it for purposes other than those mentioned above, namely marketing and advertising for the Organiser and its partners.
  4. d) The winning participant agrees that its name may be published and used free of charge by the Organiser in any advertising material.

In the event of non-compliance with these conditions, the Organiser reserves the right to refuse to award the prize and to disqualify the participant.

The organiser reserves the right to amend this regulation, with any changes being made public.

The Organiser also reserves the right to discontinue the campaign without the right to compensation and without any obligation to give notice.

  1. Taxes

In view of the nature of the Advertising Campaign, the Organiser will not have to pay taxes on earnings earned by the winner, according to the provisions of the Tax Code.

  1. Disputes:

Possible disputes between the Organisers and the participants in the campaign will be solved amicably or, insofar as this is not possible, disputes will be settled by the competent courts in Bucharest.

The organiser will not assume any liability with regard to the claims of third parties or institutions on the prises won by the participants.

The Organiser assumes no responsibility for the failure of landlines and / or mobile networks or Internet networks.

The Organiser assumes no liability if false or erroneous information is provided.

The organiser is not responsible for any malfunctions in the campaign due to third party actions such as: electricity distributors, operators, owners or administrators of telecommunication networks or the like.

The organiser reserves the unilateral right to disqualify a text / comment participating in the campaign if it considers it to be licensed or indecent.

The organiser only assumes responsibility for awarding prizes.

The organiser reserves the right to delete posts that damage the image of the company or its registered competitors, either directly or through association.

The Organiser is not responsible in any way for the content generated and for users registered in this campaign, or for the consequences thereof.

  1. Complaints

Any complaint about the campaign will be submitted in writing to the Organiser at the address of his / her office, within maximum 5 days from the date of the occurrence of the alleged event, under the sanction of not taking it into account.

  1. Campaign Rules:

Campaign rules are available free of charge to any applicant on www.eventim.ro until 01.02.2019.

Participation in this campaign implies the irrevocable and unconditional acceptance of the provisions of this Regulation and the obligation to respect them, as well as the winning participant’s consent that his/her name may be published and used free of charge by the Organiser in any advertising material.

Winners will be posted on www.eventim.ro within 5 days of the drawing. The Organiser reserves the right to change the provisions of this Regulation at any time, or to cancel, suspend, interrupt, or extend the campaign at any time without the right to compensation or notice, subject to the announcement of changes on the website.

Changes / modified form of the Regulation take(s) effect immediately after publishing online. The organiser disclaims any responsibility for how or when participants are informed about changes to the Regulation as long as they are displayed on the campaign’s website.

If the campaign is interrupted or suspended, the Organiser will award the prize to the winner designated until the date of suspension or interruption, in accordance with these Regulation.

The Campaign Regulation is drafted in accordance with Romanian law.
